What kind of information we collect on this Web site, how we collect it and what we do with the information we collect?

In several areas of the IM Web site, we collect information from and about you directly, for example when we ask you to fill out a form, or by other means explained in this Privacy Policy. Knowing a little about you allows IM and its business partners to customize the Web site and provide you with quality services. We collect both personal information and anonymous information. Personal information is any information that identifies or can be used to identify, contact, or locate the user to whom such information pertains. Anonymous information, on the other hand, is information that cannot be used to identify a particular user.

Visiting IM

You can visit IM on the Web at any time to check out what the IM Web site offers without telling us who you are or sharing any information about yourself. IM does not gather any system information about you.

Download of VAMP Software

During the downloading process, the VAMP software automatically checks your hard disk for missing soft-or hardware and compatibility with the VAMP software. Such information will not be collected by IM. If any interruption or problem occurs during the downloading process, a message will be sent to the IM server. IM will keep a record of such problems. IM will not use this information for any other purposes than to improve the VAMP software and the downloading process ("debugging").

Registration and Installation of the VAMP Software

Before you can install the VAMP software on your computer, you will be asked to register and accept the terms of the license agreement. During the registration, IM will ask you for personal information. Please note that you are under no legal obligation to submit any kind of information to IM at any time. However, to register successfully and be able to use our services beyond just visiting our Web site, we require that you supply at least nickname, password, password hint, your name, gender, age group, and country. IM may ask you for additional information, such as your interests or other information that may vary. Supplying such additional information is optional and withholding it does not preclude you from visiting the IM Web site. However, without supplying the required minimum of information, you will not be able to download the VAMP software which is necessary to access and use most of IM's services. Also, the more information you volunteer, the better we are able to customize your experience by offering the content you are most interested in. Once you have registered, you are no longer anonymous to IM: Your nickname will become your member ID and we will create an IM Member Account for you. Generally, the personal information you enter upon registration will be used only to construct aggregate demographic or statistical pictures of our user trends. Utilization of the VAMP

When you use the VAMP, we use a log file to learn more about how you use the VAMP so we can personalize your use of the IM Web site or the VAMP, according to your individual tastes and interests. For example, we may track how much time a user spends with the VAMP, the number of video clips created, and what material is uploaded to and download from the IM site with the VAMP. The profiling information gathered through the VAMP may be linked to your personal information.

Friends List

As part of the VAMP features, you may create a list of friends, which shall include their e-mail addresses. IM does not access your personal e-mail list. Any name or e-mail address that you enter in your such list can be accessed and used only by you.

Contest, Promotions and Similar Events

When you participate in a contest, a promotion or similar event, the way personal information is collected and used can differ from this Privacy Policy because the rules and terms of each event vary. Where personal information is used in a way that deviates from this Privacy Policy, the relevant changes to this Privacy Policy shall be posted during such an event. We therefore ask you to read carefully the terms and rules of each contest, promotion or similar event you wish to participate in. Generally, personal information is collected and used the following way: When you enter a contest, promotion or similar event on IM, you may be asked for personal information such as your name, mailing address and e-mail. This information is needed so winners can be notified and, when applicable, the winner's prizes can be shipped to them. In some types of events, your e-mail address may be used to update you on your score, entries, and status of prize drawings. When you participate in these types of promotions, you automatically receive promotion-related e-mail, unless you choose the no-e-mail option that some promotions offer. Occasionally, these promotion-related e-mail messages might include targeted advertisements. PLEASE NOTE THAT BY PARTICIPATING IN SUCH AN EVENT, YOU AGREE TO THE RELEVANT TERMS AND RULES INCLUDING ANY CHANGES TO THIS PRIVACY POLICY.

Advertising

In our role of delivering targeted advertisements, IM plays the middleman. Advertisers give us an advertisement and tell us the demographic criteria of the audience they want to reach (for example, males between 18-25 years old). IM takes the advertisement and displays it either on its Web site or at the banner space of the VAMP software, to users meeting those criteria. In this process, the advertiser does not collect and does not have access to any personal information.

Online Profiling

Currently, IM does not allow any outside company to apply online profiling through the IM Web site. To learn more about what online profiling is and how information can be gathered by online profiling through "banners", please click here.

Links on the IM Web site to other Web sites

Please be aware that on Web sites that have links on our site, personal information may be collected from you. The information practices of those Web sites are not covered by this Privacy Policy. IM cannot control, nor is it responsible for, the privacy practices or the content of any other Web site, and we encourage you to read each site's own privacy policy whenever you visit such other sites.

Links on IM Home Pages

IM may review the links placed by users on their IM home pages and create aggregate statistics of our users' favorite sites, but we do not track or store any information about which sites a particular user favors.

Send This Page to a Friend

When you use our "Send this page to a friend" service, we will not use the e-mail addresses that you provide for any purposes other than to send your e-mail message to your friend.

Search the Site

When you search the IM Web site, we may track and catalog the search terms that users enter in the Search area to create aggregate user statistics. This way, we can learn more about what interests our users have and improve our site to meet those interests. However, we do not track which terms a particular user enters.

Interactive Polling/Voluntary Customer Surveys

When IM conducts interactive polling or voluntary customer surveys on the IM Web site, it does not gather any personal information about you and your vote or survey information will not be linked to your name or any other of your personal information. IM uses the polling and survey results to better understand the interests of our users and may display the result of the polling or survey in figures or percentages, or in other abstract ways, on the IM Web site. However, IM is not obliged to display any results and will do so only where it believes it to be interesting to its users.

Contact

When you contact IM by mail or e-mail, IM will use the return address or return e-mail address for no other purpose but to answer your inquiry. We may keep a record of such correspondence for administrative purposes.

What cookies are and how they are used?

A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer's hard drive. The use of cookies is an industry standard, and many major web sites use them to provide useful features, such as customizable and personalized services, to their users. Even though each cookie has a unique identification number, cookies in themselves do not personally identify users, although they do identify the user's computer and passively track its activities on the web-site. Cookies from Outside Companies/"Online Profiling"

Some Web sites use outside advertising companies that display so-called "banners". Banners are small graphic advertisements that appear in boxes above, under, or to the side of the primary site content. Such banners may contain cookies that help an advertising company to better understand usage patterns and target the banners according to the information gathered. This kind of information gathering is generally referred to as "online profiling"; the information collected as "profiling information". Currently, IM does not allow any outside company to place cookies through banner advertisements or apply "Online Profiling" through the IM Web site.

Who collects the information?

When you are on IM and are asked for personal information, you are generally sharing that information with IM alone. However, in certain circumstances, companies other than IM may collect personal information. These circumstances depend on who administers the particular service:

Whether and with whom any of your information may be shared?

The protection of your personal information by which you can be identified as an individual user is of utmost importance to IM. Therefore, our Privacy Policy regarding the share and transfer of such personal information to parties other than IM ("Third Parties") is even stricter than the share and transfer of non-personal information, such as aggregate users statistics.

Personal Information

As a general rule, IM will not sell, rent or disclose to any party other than IM ("Third Party") any of the personal information we have collected from you. If we share personal information about you we will do so only when we have informed you about it prior to the collection or transfer, including in this Policy. In such cases, you will have the option of not permitting the collection or transfer, and we will always respect your choices. However, we may share personal information in any one of the following circumstances:

Share of Personal Information with Contracting Agents

IM may use contracting agents to perform services on IM's behalf (for example, to help provide technical support services). At times, we may need to disclose information about you to our contractors limited to what is necessary for them to perform specific services for IM. IM requires such contractors to keep your information strictly confidential and to use the information solely on behalf of IM and in accordance with the principles of this Privacy Policy. These contracting agents shall be restricted in writing from releasing your information to Third Parties. For purposes of this Privacy Policy, such contractors are not considered Third Parties and IM may disclose personal information to such contractors without additional notice.

Share of Personal Information with Third-Party Sponsors

Many events, such as promotions, contests and sweepstakes, offer opportunities to request additional information from sponsors. By requesting more information, you give IM the permission to transfer your personal information to the sponsor so they can fulfill your request. Only such information that is relevant to the specific request will be shared. In many instances, this will only be your e-mail-address.

Editor's Picks

From the video clips posted to IM, IM may pick one clip and present it as the "Editor's Pick". Please be aware that by posting your clip, you allow IM to publish your nickname on the IM Web site in connection with your winning clip. However, IM will not disclose your real name or any other personal information without your consent.

Special Circumstances

IM may disclose personal information, such as Member Account information, in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating IM's Terms of Service or may be causing injury to or interference with (either intentionally or unintentionally) IM's rights or property, other IM users or anyone else that could be harmed by such activities. IM may disclose or access Member Account information when we believe in good faith that the law requires it, or compelled by court order, and for administrative, regulatory or other purposes that we deem necessary to maintain our Web site, products and services.

Information Submitted by You to IM's Public Areas

IM will never knowingly reveal your information to other users unless there are special circumstances. However, there are certain situations where the information you reveal will be available or visible to other users: Chat rooms, forums, home pages and personal profiles are features that are offered within the community area of IM. Any personal information such as photos, images, original music and video clips that you upload to your homepage can be downloaded and viewed by other users. Please note that disclosing personal information through chat rooms, forums and homepages makes the information that is submitted public. Such disclosure may increase your chance of receiving "spam" or unsolicited e-mail. Please be careful and use discretion when disclosing this information on-line. To further the protection of your privacy, IM advises you to choose as a login name a nickname that does not have any reference to your real name.

Aggregate, Statistical Information

IM may disclose aggregated, demographic user statistics (for example, 45% of our users are female) in order to describe our services to prospective partners, advertisers and other parties, and for other lawful purposes.

Third-Party Information

Unless otherwise detailed in this Privacy Policy, IM will not link or match personal information with any Third-Party information.

What choices are available to you regarding collection, use and distribution of your information?

Whenever necessary and reasonable, IM gives users the opportunity to make informed choices regarding the collection, use and distribution of their information. Naturally, you may at any time refrain from using the IM Web site in the event that you disagree with our Privacy Policy or any part of it. Further choices include: Removal from Mailing List During registration, you are given the opportunity to decline further e-mail notification of news and events. In addition, you can remove yourself from the mailing list at any time by visiting our Web site and unsubscribing there; http://www.imvamp.com or by simply following the instructions included at the bottom of any IM generated communication that you receive. However, you may not opt out from being contacted in matters that we deem necessary for the administration of your IM Member Account or the IM Web site and its products and services.

Non-Disclosure to Third Parties

If your personal information is collected, maintained by, or shared with a Third Party, we will notify you at the time of the collection or transfer. You will always have the option of not permitting the transfer, except under the events listed in this Privacy Policy, and we will always respect your choices. If information is being collected and/or maintained by any company other than IM, you can choose not to allow the collection at the time of registration for that service, or you can choose not to use that particular service. Please note that by doing so, you will not be able to participate in any contests, promotions, sweepstakes or giveaways on the IM Web site, and any other service where your personal information is required.

What our policy is regarding the review, update, correction or deletion of your information?

In our striving to allow you maximum control on the information you submitted to us, IM gives you wide opportunities regarding the review, update, correction and deletion of your personal information.

IM Member Account Information

We want to make sure that the Member Account information you submitted upon registration is accurate and up to date. Therefore, after registration, you may at any time and as often as necessary click on the Community Bar / My Links option of your VAMP and, after entering your login name and password, review the information. You may edit and correct any information except for your nickname and real name, and delete any information that is not mandatory. IM will not keep the information you have changed in its records in the form of personal information. However, any information that you have submitted up to that date will remain part of the IM aggregate user statistics. If you detect any factual errors in the information that you may not edit yourself, please send us a request that credibly shows the error to our mail address or per e-mail at this form. If you wish to have your IM Member Account deleted, you can do this simply by uninstalling the VAMP software. The next time you go online, a notification will be sent to the IM server and your Member Account including your personal information will be deleted from our database. Deletion means that you will not be able to access any of IM's services that require registration. However, after having installed the VAMP software on your computer, you may not ask IM to delete such information as necessary to identify you as a party to the license agreement.

VAMP User Pages

You may edit your own VAMP User Page at http://www.imvamp.com/userpages/index.html. You can change the contents and layout of your home page at any time by entering your login name and password, going to your home page and clicking the "edit" option.

Mailing List

If you have subscribed to our mailing list and wish to be removed, you may at any time go to the left-hand navigation bar of any of our Web pages and unsubscribe by checking the appropriate box. If your e-mail address has changed, you may either unsubscribe and subscribe under your new e-mail address, or send an e-mail to this form and ask for your e-mail address to be updated.

Contest, Promotions and Similar Events

If you are participating in a contest, promotion or similar event administered by IM alone or IM together with a business partner, and you wish to update your e-mail address on the event mailing list or to quit an event and cease receiving event-related material, please contact us. For changes regarding events administered solely by Third Parties hosted on the IM Web site, you must contact the Third Party at their contact (e-mail) address.

What efforts we make to protect your information from loss, misuse, or alteration?

IM is committed to protecting your personal information from loss, misuse and alteration. Whenever IM handles personal information as described in this Privacy Policy, IM takes steps to ensure that your information is treated securely and in accordance with the relevant Terms of Service and this Privacy Policy. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, IM cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems. IM has international sites and users all over the world. Software-based Security Measures we use to Protect your Personal Information

For the security of your information, we use standard software, for example SQL and firewall technology. SQL (Structured Query Language) is a standard interactive and programming language for getting information from and updating a database. Its security mechanism depends upon correct user identification. Firewalls are security systems that restrict traffic between a secure network and the outside world to protect critical data from outside attack while allowing legitimate access.

Process and Procedure Ensuring Security of Your Personal Information

The IM member account information is password-protected so that only you have access to this personal information. We recommend that you do not divulge your password to anyone. IM will never ask you for your password in an unsolicited phone call or in an unsolicited e-mail. At a minimum, we encourage you to change your passwords often, using a combination of letters and numbers, and make sure that you are using a secure browser when you surf the Internet. Also, remember to sign out of your IM member account and close your browser window when you are finished using the IM Web site or the World Wide Web. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or an Internet cafe. Ultimately, you are solely responsible for maintaining the secrecy of your passwords and/or any Member Account information. Please be careful and responsible whenever you are online.

What happens when our Privacy Policy changes?

We periodically revise our Privacy Policy to keep it up to date with the development of our products, services and Web pages, as well as the regulations or customs of trade. What about children under the age of 13?

IM is committed to and respects the privacy of children under the age of 13. Our Web sites and the services offered on the sites are directed at teenagers and adults and are not targeted at children under the age of 13. To protect the privacy of children, we do not permit registration, request or collect personal information from children under the age of 13. No such information should therefore be submitted or posted to IM by users under 13 years of age. Also, other users should not submit or post information to IM about or on behalf a child under 13 years of age.
